I liked Judge Kilgannon until he said claim was unfavorable. I don’t know how he expects me to work, even VE doesn’t think I should work. I’m almost ready to pack it in.

DBC Judge: April M Wexler 4/24/2017 6:42:33 PM       Unfortunately I have to write a Response for others in regards to Judge April Wexler. A denial is acceptable and happens ....but misinformation and actual Lies should be addressed. A short background for me is 3 neck surgeries and back issues .. spinal cord myelopophy.. spinal cord infection..spinal cord flattening resulting in partial paralysis on the right side of my body intense migraines and facial, right arm, right leg numbness with Clonus in my ankles. I have had a career for all my life and was involved in a work related car accident which left me disabled and forced from my career and much of life at this point. I feel Judge Wexler was unsympathetic and bit short at the hearing (I was warned of this by my Attorney) But judges tend to be this way and that's understandable. Judges just want to know the facts and evidence...Shortness from them does not bother me. Denied?? Yes! But that is also ok. But her unfavorable letter is littered with falsities and untruths which anyone would find insulting and disturbing. Especially those of us that deal with disability, pain and discomfort everyday. Denial From Judge April Wexler is as follows.... 1. He went on Vacation to Florida to visit his father did not need assistance to board airplane. Truth...Went on vacation one time in the Past 3 years and Flying is difficult for me and I needed assistance from fiancé to get on plane and an aisle seat so I can stand throughout the flight periodically. 2. "he can groom , himself , shower but does on occasion need his fiancé to help with socks shoes and undress" Truth.., Embarrassing..but yes my Fiance helps me dress ..socks shoes and pants at least once a week. Standard with spinal cord damage. 3. "Fiance cooks and cleans but he cooks assisted once a week." Truth... I used to enjoy cooking but need help with pots and pans. she does most of the work but it makes me feel good cooking a meal even if assisted. she cleans up 4." Goes out to dinner once a month. "Truth.. does that make me disqualified for SS disability?? HMMM 5. Can help his 3 Children with Homework and daily needs. Truth... My children Live out of state 1000 miles away. when they visit , 3 times a year, its difficult but they understand my situation. Im Not involved with their day to day needs UNFORTUNATLY!!THANKS FOR THE SHOT AT MY FAMILY SITUATION JUDGE WEXLER!! 6. "He socializes with his family , friends and fiancé on a daily basis..."Truth...Yes I talk to my Fiance everyday because she lives with me. I contact my children and talk to my family via telephone daily. AND?? 7. "Can drive once a week..." Truth...My Fiance drives everywhere for me...I drive to 7-11 less than a mile away when needed but can not drive long distances at all! due to migraines, neck pain and clonus in my right leg. 8. 5 Doctors opinions including SS disability Doctor.. Judge Wexler "Does not find weight." Doctor 1.....Pain management...." I Put no Weight on this... Dr. states Markedly Disabled and had spinal cord infection and had Removal of hardware and spinal cord infection. there is no mention of this in surgical report" Truth..... Actually there is that exact wording in surgical report. Doctor 2....2nd pain Management DR...."states disability but states theres no Myoclonus in right leg" Truth...The Dr Clearly states in his notes Myoclonus due to Cervical Myelopophy in right ankle , leg as does other doctors report. Doctor 3.....Orthepedic Surgeon....Wexler says "DR. States initial Surgery was a "Home run" ,she mentions that twice in my unfavorable Decision... Truth.... 2 years after my initial surgery I saw a new Orthepedic surgeon who stated to me my initial surgeries were abominable and he wanted to do a 4th surgery.. I did not want to at that point. he stated in his notes " Surgical intervention will be considered if Pain management cortisone injections are not a "Home Run".. OUTRIGHT LIE BY WEXLER. Or possibly that's whats she read and comprehended due to complete incompetence. Doctor 4....Pain Management Dr.....90 percent Disabled...."I find no weight in this"... Truth...."HMMMM Not sure why?" Doctor 5....SOCIAL SECURITY DOCTOR..Who stated....."Moderate to severe limitations on lifting,Squatting,kneeling ,crouching and stair climbing..Can not sit long periods of time..limitations using right hand and marked weakness." Judge Wexler responds.. "Generally good Weight but no support to hand limitations"... Truth...THIS IS THE SOCIAL SECURITY DOCTOR!!. The one they sent me too.! So this is what your up against with Judge April Wexler...Judge and Attorney? Supposedly!!! Doctor????? She feels she is! Medical school? Im not sure!! Theres more to my decision but the typing has given me a migraine and pain(literally) So ill leave at this. If you have this judge ...Good Luck!!
